Note! The rules of crossing the border with the Republic of Poland changed – Update as at 13.06.2020

First, it should be recalled that, in accordance with the epidemic emergency introduced in the territory of the Republic of Poland, in order to prevent the spread of the SARS-CoV-2 coronavirus, as of 15 March 2020, the  border control at the internal border has been temporarily restored. On the external border (border crossings with Belarus, Russia and Ukraine), restrictions for foreigners on entry to Poland have been introduced.

Pursuant to the regulation of the Council of Ministers of 12 June 2020, amending the regulation on establishing certain restrictions, orders and bans in connection with the occurrence of the epidemic (Dz.U.2020 poz. 1031), (“Regulation”), borderline checks were discontinued along the entire section of the internal border at night from 12 to 13 June 2020.

The above limitation of restrictions only applies to internal borders. There are still restrictions regarding the entry of foreigners into Poland from outside the EU.

As regards the above regulation, as of Saturday, 13 June, one will be able to travel freely and cross the internal borders of the European Union. There will be no border checks and people entering Poland will not be subject to mandatory quarantine.

WHO CAN CURRENTLY ENTER POLAND?

At present, the following may enter the territory of Poland:

  • citizens of the Republic of Poland,
  • foreigners who are spouses or children of citizens of the Republic of Poland or remain under their constant care, foreigners holding a Pole Card,
  • heads of diplomatic missions and members of the mission’s diplomatic and consular staff, i.e. persons with a diplomatic rank and members of their families,
  • foreigners who have the right of permanent or temporary residence in the territory of the Republic of Poland,
  • foreigners who have the right to work in the territory of the Republic of Poland, i.e. foreigners entitled to work under the same conditions as Polish citizens, who have a work permit, a certificate of entry in the register regarding seasonal work, a statement on entrusting work to a foreigner on the territory of the Republic of Poland Polish who:
    • perform work in the territory of the Republic of Poland, or
    • present documents that show that work will start immediately after crossing the border. There is no closed catalogue of documents confirming the fact of performing work in Poland and which foreigners must show to the borderline guards officers while carrying out activities related to border checks to enter Poland,
  • foreigners who run a means of transport for the transport of persons or goods, and their transit takes place as part of their professional activities consisting in the transport of goods or the transport of persons,
  • drivers performing road transport as part of international road transport or international combined transport traveling through transit through the territory of the Republic of Poland by other means of transport than the vehicle used for road transport:
    • to collect rest on the territory of the country of stay,
    • after receiving the rest referred to above and after a break in the performance of work in the circumstances specified in the Act on drivers’ working time,
  • pupils and students receiving education in Poland.

AS OF 13 JUNE, THE FOLLOWING CAN ENTER THE POLISH TERRITORY

  • citizens of European Union member states, European Free Trade Agreement (EFTA) member states – parties to the Agreement on the European Economic Area or the Swiss Confederation and their spouses and children, in order to travel through the territory of the Republic of Poland to their place of residence or stay,
  • foreigners with a permanent residence permit or a long-term resident’s European Union residence permit, in the territory of other European Union Member States, a Member State, the European Free Trade Agreement (EFTA) – parties to the agreement on the European Economic Area or the Swiss Confederation and their spouses and children in order to transit through the territory of the Republic of Poland to the place of residence or stay.

It is worth adding that in specific justified cases, not included above, the commander of the Border Guard post, after obtaining the consent of the Chief Commander of the Border Guard, may allow foreigners to enter the territory of the Republic of Poland. The specific case is verified each time when crossing the border.

In connection with the opening of internal borders, rail and air connections are successively launched.

WHO IS NOT SUBJECT TO QUARANTINE AFTER ENTERING POLAND?

After crossing the border of the Republic of Poland as part of their professional activities, the following do not need to quarantine:

  • crew members of aircraft,
  • seamen, fishermen and other members of sea ship crews and inland waterway vessels, as well as ship servicemen and maritime administration inspectors or recognized organizations to carry out inspections,
  • persons performing work or providing services on ships or offshore mining and drilling platforms,
  • persons performing works related to the preparation or implementation of investments in the terminal in Poland or a neighboring country within the meaning of the act on investments in the field of regasification terminal for liquefied natural gas in Świnoujście, strategic investments in the field of transmission networks within the meaning of the Act on the preparation and implementation of strategic investments in transmission networks or strategic investments in the oil sector within the meaning of the Act on the preparation and implementation of strategic investments in the oil sector,
  • drivers performing road transport as part of international road transport or international combined transport within the meaning of the provisions of the road transport act,
  • train crew and other employees necessary to perform freight transport services under international rail transport, performing professional activities in Poland or a neighboring country, on the basis of a list provided by the carrier,
  • drivers performing road transport of motor vehicles or vehicle combinations with a permissible total weight not exceeding 3.5 tonnes in road transport of goods and non-profit road transport of goods,
  • drivers performing road transport with vehicles intended for the transport of more than 7 and not more than 9 persons, including the driver in commercial international road transport of persons.

In addition, the following are exempt from the obligation to quarantine after crossing the border with Poland:

  • pupils and students receiving education in Poland,
  • soldiers of the Armed Forces of the Republic of Poland or allied forces, officers of the Police, Border Guard, Customs and Tax Service, State Fire Service and State Protection Service, inspectors of Road Transport Inspection, performing official tasks,
  • members of diplomatic missions, consular posts and representatives of international organizations and their family members, as well as by other persons crossing the border on the basis of a diplomatic passport,
  • maritime administration inspectors,
  • EU, EEA or Swiss citizens, and their spouses and children to travel through Poland to their place of residence or stay,
  • foreigners who have a permanent residence permit or a long-term resident’s European Union residence permit to cross the territory of other European Union Member States, a Member State, the European Free Trade Agreement (EFTA) – parties to the agreement on the European Economic Area or the Swiss Confederation, and their spouses and children, to travel through the territory of the Republic of Poland to their place of residence or stay.

Quarantine can only be shortened by a state sanitary inspector competent for the place of quarantine or another, authorized by the Chief Sanitary Inspector in particularly justified cases.
